Terms and Conditions of Use and Purchase

Owner: Ubora Producciones, S.L. (Tax ID B86503232, Calle Doce de Octubre 5, 28009 Madrid, Spain) — hereinafter AgilityEurope, the Platform or the Owner.
1. Purpose and scope
These Terms govern the use of https://agilityeurope.com and the contracting of the services offered there: (a) information services about dog agility; (b) the Marketplace, a classifieds platform for buying and selling second-hand agility items (obstacles, equipment, trailers and other); (c) the Secure Payment service (payment intermediation with funds held); and (d) the transport arrangement service for the items.
2. Definitions
User: a registered person using the Platform.
Seller: a user publishing a sale listing.
Buyer: a user purchasing an item.
Listing: a publication offering an item for sale or wanted.
Secure Payment: the service by which the amount paid by the Buyer is held by the payment provider until delivery confirmation.
Trader: a user selling within their business or professional activity; otherwise the user is deemed a private individual.
3. Role of the Platform
3.1. AgilityEurope acts solely as a technical intermediary between Sellers and Buyers. The Platform does not own, sell or resell the listed items and is not a party to the contract of sale, which is concluded directly between Buyer and Seller, without prejudice to Article 6 of Regulation (EU) 2022/2065. The Platform will always present listings in a way that makes it clear the item is offered by the Seller and not by AgilityEurope.
3.2. AgilityEurope does provide: (a) the payment intermediation service under clause 7; (b) the transport arrangement service under clause 9; and (c) the listings publication service.
3.3. The Platform may moderate, hide or remove listings or accounts that breach these Terms; moderation decisions do not give rise to any right to compensation.
4. User account
The user must register with truthful data, keep their credentials confidential and be at least 18 years old. Each user is responsible for activity carried out from their account.
5. Publishing listings
5.1. Publishing listings is free. Listings stay published for 45 days, renewable.
5.2. Allowed categories: agility obstacles, equipment and gear, trailers, and other items related to agility.
5.3. Prohibited from being listed: animals (in any form), illegal, counterfeit or stolen items or items infringing third-party rights, and any content unrelated to the purpose of the Platform.
5.4. The Seller guarantees ownership and availability of the item and the accuracy of the listing (description, condition, own representative photographs).
5.5. The Seller declares whether they act as a private individual or as a Trader, which status the Platform may verify under Article 30 of Regulation (EU) 2022/2065 (DSA) for professional sellers.
6. Prices and fee
6.1. Prices are freely set by the Seller in euros.
6.2. Platform fee: on sales completed through Secure Payment, AgilityEurope deducts a 6% fee on the sale price, withheld from the amount transferred to the Seller. All other services (publishing, search, messaging) are free.
6.3. The Platform will issue and make available to the Seller, for each completed sale, an invoice for the accrued fee, with the VAT applicable according to the Seller's tax status (see clause 6.4).
6.4. Taxation of the fee. The fee is the price of the intermediation service provided by AgilityEurope and gives rise to: (i) Spanish VAT (21%) where the Seller is a private individual or a business established in Spain; (ii) no VAT under reverse charge where the Seller is a business established in another EU Member State with a valid intra-community VAT number (VIES); (iii) it is outside the scope of VAT where the Seller is a business established outside the EU. The 6% fee is understood as VAT inclusive: where Spanish VAT applies, of each EUR 6 of fee, EUR 4.96 is the taxable base and EUR 1.04 the VAT amount (6 / 1.21).
7. Secure Payment (funds held)
7.1. Payments are processed by Stripe (Stripe Payments Europe, Ltd.), a regulated payment institution. Buyer funds are held by Stripe — not by AgilityEurope — until delivery is confirmed. Card details are entered directly into Stripe and never pass through the Platform's servers.
7.2. Flow: (a) the Buyer pays the item price; (b) the Seller ships and marks the order as shipped; (c) the Buyer confirms receipt; (d) Stripe releases to the Seller the price minus the 6% fee.
7.3. If the Buyer neither confirms delivery nor files a claim within 14 days of the shipping mark, the Buyer must contact support (info@agilityeurope.com) for manual review of the case; the Platform may release the funds when it reasonably establishes that effective delivery took place.
7.4. Refunds: before shipping, the Buyer may cancel and obtain a full refund. After shipping, the Buyer has a claim if the item does not arrive or differs substantially from the listing; the Platform will mediate and may carry out a full or partial refund where appropriate.
7.5. To receive payments, the Seller must complete Stripe Connect verification (identity and IBAN) and accepts the Stripe Connected Account Agreement. AgilityEurope may suspend payments on indications of fraud or misuse.
7.6. Prohibition of evasion: agreeing between users to pay outside Secure Payment in order to avoid the fee may result in account suspension.
7.7. Chargebacks. The Buyer retains the rights to charge back their payment to their bank. If, after the funds have been released, a chargeback attributable to fraud or to the Seller's breach occurs, the Seller must reimburse the Platform the amount of the chargeback plus associated costs; the Platform may offset it against future operations or claim it directly.
8. Right of withdrawal and returns
8.1. Sales between private individuals (C2C): the right of withdrawal under Articles 102 et seq. of Royal Legislative Decree 1/2007 (TRLGDCU) does not apply, as this is a contract between private individuals outside any business activity. The refund rules in clause 7.4 apply.
8.2. Sales from a Trader to a consumer (B2C): the consumer Buyer has 14 calendar days from receipt to withdraw, notifying the Seller and the Platform (the standard withdrawal form in Annex B of the TRLGDCU is provided on request). The exceptions in Article 103 TRLGDCU apply (in particular, items made to measure or clearly personalised — relevant for custom obstacles). The refund includes the cost of the initial ordinary shipping if the Trader charged it; the Trader will refund within 14 days of the withdrawal notice and may withhold the refund until the item is received back. Return costs are borne by the Buyer unless the item does not match the listing. The Trader Seller must accept the return, and the refund will be executed against the held funds or by claiming from the Seller amounts already released.
8.3. The Trader Seller is solely responsible to the Buyer for compliance with consumer law (guarantees, withdrawal, conformity of the item).
9. Transport arrangement service
9.1. The Buyer may request a transport quote on any listing. AgilityEurope will arrange the shipment with partner carriers and send the Buyer a fixed price, which the Buyer may accept or decline without obligation.
9.2. Accepting the quote and paying it constitutes the contracting of the transport arrangement service with AgilityEurope.
9.3. Stated timeframes are estimates and are not guaranteed. Liability for loss or damage during transport lies with the executing carrier; AgilityEurope will channel the claim to the carrier and inform the Buyer of the outcome. Keeping the packaging and documenting the condition on delivery is recommended.
9.4. The transport service is independent of the contract of sale of the item.
10. User messaging
The Platform provides internal messaging without disclosing users' email addresses. Use for spam, fraud or fee evasion is prohibited.
11. Obligations and prohibited conduct
Prohibited: publishing illegal, false or misleading content; defrauding; using the Platform for the sale of animals; manipulating reviews or ratings; evading the fee; or interfering with service security. Breach may lead to listing removal, account suspension and funds being held at the disposal of the competent authority.
12. Platform liability
12.1. The Platform does not guarantee the accuracy of listings nor users' fulfilment of their obligations, although it performs moderation.
12.2. AgilityEurope's maximum liability to a user, for any cause arising from the use of the Platform, is limited to the fees actually collected from that user in the 6 months preceding the triggering event. This limitation does not apply: (i) to the willful misconduct or gross negligence of AgilityEurope; (ii) to death or personal injury; (iii) to consumers' non-waivable rights under the TRLGDCU and other mandatory law; (iv) to breach of the essential obligations of AgilityEurope's own service (including proper management of the payment flows and of the contracted transport service).
12.3. Nothing in these Terms limits consumers' non-waivable rights under the TRLGDCU and other mandatory law.
13. DSA — illegal content notice channel
Under Regulation (EU) 2022/2065, anyone may report allegedly illegal content to info@agilityeurope.com stating the URL and the grounds. The Platform will examine and decide on the reported content with due diligence.
14. Amendments
AgilityEurope may amend these Terms giving 15 days' prior notice on the Site. Operations started before entry into force are governed by the previous version. If the user does not accept the amended Terms, they may terminate their account before entry into force; continued use of the Platform will constitute acceptance.
15. Governing law and jurisdiction
These Terms are governed by Spanish law. For consumer users, the courts of their place of residence shall be competent. For users acting as professionals or businesses, the parties submit to the courts of Madrid capital, expressly waiving any other jurisdiction.
